Two separate class-action lawsuits have been filed against Apple, one by plaintiffs in IL and the other from California. A press release for one of the lawsuits, led by the Atlas Consumer Law group in IL, says Apple's "iOS updates, plaintiffs claim, were engineered with this very goal in mind-fraudulently forcing iPhone owners to purchase the latest model offered by Apple".
"Plaintiffs and Class Members suffered interferences to their iPhone usage due to the intentional slowdowns caused by Defendant".
A class-action lawsuit recently filed in California alleges that Apple never requested or gained consent from customers to "slow down their iPhones". While it is possible to see the slowing down of devices as a way of prolonging their life, many iPhone owners will be asking why the company chose to wait so long to be honest about what it has been doing. Instead, Apple is only attempting to fix a known issue with iPhone battery degradation. While there are some obvious gray areas about how Apple handled the rollout of this battery/performance balancing tactic, the lawsuit fails to take into account the technical side of the feature and how all lithium-ion batteries are subject to normal wear.
